1. Introduction

Welcome to The Kate. These Terms of Service (“Terms”) govern your use of our services, including leasing, residency, and communications. By using our services, you agree to these Terms.

2. Services Provided

The Kate communicates with residents via SMS, MMS, RCS, and email for leasing, maintenance, and community updates.

3. Consent to Communications (TCPA, CTIA 5.1.2)

Providing your contact information authorizes us to send informational and promotional messages. Marketing messages require your express written consent and are not a condition of residency.

4. Opt-In and Opt-Out Procedures (CTIA 5.1.2.2, 5.1.3)

• Opt-In: Consent may be given by texting “JOIN” to 940-245-6506 or through your lease application. Consent is campaign-specific.
• Opt-Out: To stop receiving messages, text “STOP” to 940-245-6506. Opt-outs are honored immediately.

5. Message Frequency and Charges (TCPA Notice)

Message frequency varies. Standard message/data rates may apply. Contact your carrier for more info.

6. Acceptable Use (CTIA 5.3)

Users must not:

• Send spam
• Commit fraud
• Violate laws or misrepresent themselves

7. Emergency Messaging Disclaimer

SMS and related messages are not intended for emergency use. For emergencies, call 911 or use appropriate services.

8. Maintenance Requests Protocol

Maintenance issues can be reported via our official request form or SMS (non-urgent only). Urgent matters should be called in directly. Response times vary by issue severity.

9. Data Collection and Use (CTIA 5.1.4, 5.2.1)

Your data is used as per our Privacy Policy. We do not sell or share your data without explicit permission.

10. Data Security (CTIA 5.2.2, 5.2.3)

We use administrative, physical, and technical safeguards and conduct routine audits to protect your information.

11. Non-Transferability of Services (CTIA 5.1.2.2)

Messaging services are specific to your lease and may not be transferred to others.

12. Do Not Disturb Hours

Non-urgent or promotional messages will not be sent between 9 PM and 8 AM local time.

13. Record Retention Policy

Records of communications and interactions may be retained for up to seven years for compliance and quality assurance.

14. Governing Law and Jurisdiction

These Terms are governed by Texas law. Disputes shall be resolved in the courts of Wichita County, Texas.

15. User Acknowledgement

By interacting with our services or providing your contact details, you acknowledge and accept these Terms.
